Getting caught for downloading torrents in Canada?

It is illegal to download whether using torrents or using a file sharing program? Copyright infringement is in itself not covered by Canada's criminal code, so you can't be arrested, or sentenced to a prison for the act of downloading torrents or using file sharing.
